Derby ONE Competitions – General Terms and Conditions

These General Terms and Conditions apply to all competitions, whether on-air, online, or otherwise promoted and operated by Derby ONE Radio Ltd (trading as Derby ONE) or by our sponsors. Specific competitions may carry additional terms and conditions, which will be made clear during promotional messages. These may include requirements for winners to participate in promotional opportunities with Derby ONE.

1. Eligibility

• Entrants must be UK residents aged 18 or over.
• Entrants under 18 must have the supervision and consent of a parent or guardian.
• Employees of Derby ONE Radio Ltd, sponsors, and associated companies, as well as their immediate families, are not eligible to enter.

2. Entries

• Derby ONE accepts no responsibility for entries that are lost, delayed, or damaged. Proof of sending (post, email, or phone call) is not proof of receipt.
• Unless otherwise stated, entries are limited to one per household or primary residence per competition. Family members at different addresses may enter separately.
• For prize draws, all valid entries will be entered into a draw from which one winner will be selected.
• Closing dates will be specified for each competition and relate to UK time.
• Entrants submitting by email are deemed to have received any reply correspondence sent by Derby ONE.

3. Winners

• Winners will be formally notified within 28 days of the competition closing date (or as otherwise specified).
• Prize details will be provided upon notification if not already published.
• Winners are not eligible to win again within 28 days of their last win.
• If a winner cannot be contacted or fails to comply with these terms, Derby ONE reserves the right to award the prize to the next eligible entrant.
• Prizes will be delivered within 28 days unless otherwise stated.
• The decision of Derby ONE’s judges or adjudicators is final, and no correspondence will be entered into.

4. Prizes

• Prizes have no cash value unless explicitly stated.
• No cash alternatives are available unless specified in competition-specific terms.
• If an advertised prize is unavailable, Derby ONE reserves the right to substitute with an item of equal or greater value.
• For tickets or vouchers, winners are responsible for all additional costs (e.g., travel, food, drink) unless otherwise specified.
• For prizes supplied directly by a third party (such as a sponsor or advertiser), Derby ONE Radio Ltd accepts no responsibility or liability for the supply, delivery, or fulfilment of the prize. In the event that a third party fails to deliver or honour the prize, Derby ONE cannot be held liable for any resulting loss, disappointment, or inconvenience.

5. Disqualification

• False declarations or entries solicited through collusion will result in disqualification.

6. Restrictions

• Cross-promotion of competitions via third-party websites or forums is not permitted.
• Entries submitted by individuals intending to exchange prizes via competition websites or forums will be disqualified.
• For competitions offering tickets or vouchers to local attractions, Derby ONE reserves the right to refuse entries from individuals deemed beyond reasonable travel distance or unlikely to use the prize themselves.
• Proof of name and address may be required before prize allocation.
• Derby ONE is not responsible for inaccurate prize details supplied by sponsors, nor for any damage, loss, or disappointment suffered by participants.

7. Telephone Entries

• Calling Derby ONE does not guarantee entry into on-air competitions.
• Callers may not appear on air, and if they do, not necessarily in the order calls were received.
• Derby ONE is not liable for any telephone charges incurred while on hold or on air.

8. Data & Records

• Valid entries will be retained for a reasonable period to administer prizes and ensure transparency.
• Invalid entries will be deleted immediately.
• By entering, participants consent to the collection and use of personal data for competition purposes, in line with UK data protection legislation (including GDPR).

9. Legal

• Entry into any Derby ONE competition implies acceptance of these rules.
• Derby ONE reserves the right to amend these rules at any time.
• Specific competition rules apply in conjunction with these General Terms and will override them in the event of conflict.
• These rules are governed by English law.
• Entry via Derby ONE’s website or on-air constitutes acceptance of these Terms and Conditions.
